To correctly write a statement of claim and give it a move, you need to know the judicial area. In the text of the document, it is essentially not reflected in any way, but it will be useful for registering a claim.
Instructions
Step 1
Take a look at articles 23-24, 26-28 of the Civil Procedure Code of the Russian Federation, which reflect the distribution of areas of responsibility. Justices of the peace consider cases related to: - dissolution of marriage; - issuance of court orders; - procedure for the use of property; - material disputes, etc. The courts of first instance include district courts, therefore the bulk of decisions on claims are made within their walls.
Step 2
Find out the address of the defendant, because the statement of claim is filed at his place of residence. If you are going to sue an organization, then take its location as a basis. If there are conditions that prevent you from leaving the defendant's place of residence, you can go to the court of your territorial district, if, of course, there are reasons for that. For example, poor health, injury or injury, and the presence of small children are considered as factors that impede movement.
Step 3
At the place of residence of the plaintiff, claims may be considered for: - protection of consumer rights; - restoration of labor, pension, housing and other rights; - compensation for harm; - divorce in the absence of disputes about children.
Step 4
Go to the site https://www.sudrf.ru/ and select the appropriate menu item. For example, if you need to find the judicial area of the justices of the peace, then click on “Courts of the justices of the peace” and fill out the proposed form. To find information about district courts from the main page, go to the section "Federal Courts of General Jurisdiction".
Step 5
Follow the suggested link to the forensic site page. On it you will find detailed information about the procedure for filing claims, the opening hours of the reception, find out the address and telephone number, as well as the name of the judge responsible for the territory entrusted to him.
