A writ of execution is an official document obliging an individual or legal entity to take actions prescribed for him during the court proceedings, for example, to pay off an existing debt. This document is submitted by the plaintiff to the bailiff service.
Instructions
Step 1
The writ of execution is submitted to the bailiff service after the expiry of the period for appealing the decision made by the court (usually 10 days). The deadline for presenting a sheet is usually three years, but there are some exceptions. For example, writs of execution on periodic payments can be presented during the entire payment period, and in the proceedings of cases of administrative offenses, the term for presenting the document is no more than one year from the date of the decision by the court.
Step 2
Determine in which of the territorial bodies of the bailiff service you must submit a writ of execution. If the defendant is a civilian, contact the bailiff service at his place of residence or the location of his property. To collect debts from an organization, submit a sheet to the bailiff service at its legal address, location of the branch, representative office or property. If the defendant is ordered to take certain actions, contact the service that is located in the appropriate place.
Step 3
Agree with the bailiff service the method of collecting the due debt from the debtor in accordance with the writ of execution. Having information about the bank accounts of the debtor, choose as a way to submit the document to the bank serving the debtor. When collecting periodic payments (if the amount to be collected does not exceed 25,000 rubles), you can present a sheet at the debtor's place of work or grant him a scholarship, pension, etc. The same rule applies to writs of execution for the recovery of alimony.
