To replace a cell phone with a similar product of another model, write a corresponding statement to the store administration, and if your request is ignored, contact the territorial bodies of Rospotrebnadzor in order to bring cell phone sellers to administrative responsibility for non-compliance with the law.

Getting the money back for the phone is quite problematic. According to the law, even in the event of a malfunction of the phone and the presence of significant defects, it is proposed to exchange the phone for an equivalent model, and not a refund.
