In accordance with article 256 of the Labor Code of the Russian Federation, an employee who is on parental leave must retain a place of work. In an unstable economic situation, the employer is sometimes forced to transfer employees to other places of work, reducing positions. What should the manager do in such a situation, because according to the law, a position is assigned to a woman, and it is impossible to transfer.

Instructions

Step 1

If you want to transfer a young mother to another place of work, get her permission. The question immediately arises: how to do this, because she is on vacation. To do this, issue a call (for young mothers, labor legislation allows this to be done). Compose a letter, address it to an employee. Be sure to include in it the reason for calling from vacation. If the employee agrees with the information provided, he must sign the document and put the date of familiarization.

Step 2

Issue a transfer notification to the employee's address. According to labor law, it must be signed by the employee no later than two months from the date the order enters into force. Therefore, in order to send an employee on vacation again, it is advisable to ask him to write a transfer application.

Step 3

Draw up an order. In the document, indicate the reason for calling from parental leave, the end date of the vacation, the employee's data. Give the administrative document to the employee for signature. Make changes to the employee's personal card, file all the documents drawn up in a personal file.

Step 4

Enter into an additional agreement with the employee to the employment contract, because you are changing one of the conditions. In the document, indicate the new position, the amount of remuneration and other working conditions. If necessary, draw up a job description and give it to the employee for signature.

Step 5

Next, issue a transfer order. In this document, indicate the details of the employee, the previous and new place of work. Be sure to indicate the basis for the transfer (additional agreement, for example), the amount of salary. Copy the document with an employee.

Step 6

After that, make changes to the staffing table and vacation schedule. Do this with orders.

Step 7

If the employee wants to go on vacation again, fill out an order based on her application. Make changes to your vacation schedule and personal card.
