Sometimes in the organization there are situations when the presence of an employee is simply necessary. But if he is on vacation? What to do then? According to the Labor Code, it is possible to issue a recall of an employee from the prescribed rest.

Instructions

Step 1

To call the employee, his consent is required. The forced call is illegal. The head of the enterprise must draw up a memo indicating the reasons for the revocation. It is not necessary to draw up this document, but in order to avoid problems with the tax authorities, it is better to draw it up. The text of this document is something like this: “Due to (state the reason), we ask you to interrupt your annual leave from (period). If you agree to this review, the unused portion of the vacation will be provided to you at a convenient time for you."

Step 2

After that, the employee can, if desired, write a statement of consent. Its text is something like this: "I agree with the withdrawal from the annual paid leave on the terms of providing the unused part of the leave."

Step 3

Based on the above documents, the head of the organization draws up an order, which should include information about the reason for the recall, as well as confirm the employee's ability to use the remaining vacation days at any convenient time. The order is signed by the manager and the employee recalled from vacation.

Step 4

It is also mandatory to enter information about the recall in the employee's personal card, where in section 8 it is necessary to indicate the vacation period, type and number of calendar days.

Step 5

Then the accountant of the organization must make changes to the vacation schedule (form T-7), and also, on the basis of the order, carry out a recalculation. The amounts paid earlier for the vacation must be returned by the employee to the cashier of the enterprise. The offset of these amounts in favor of wages is illegal, since this is not provided for by the Labor Code of the Russian Federation. From the day the employee starts work, wages should be accrued.
