There are two ways to send the first person of an organization on vacation. If in the company's charter this issue is attributed to the competence of the general meeting of founders, the vacation is formalized by its decision. Otherwise, it is enough to include the director's rest time in the vacation schedule and send him a notice within the statutory period (two weeks).

Step 1

If by the charter of the company the issue of granting leave to its first person is attributed to the competence of the general meeting of founders (or shareholders), the director (general director, president, etc.) must submit an application addressed to the chairman of the board of founders or the general meeting of shareholders with a request to consider the issue on granting him leave. At the same meeting, it is decided who will perform the duties of the first person during his absence (usually a deputy or first deputy, if any).

All this is formalized by the minutes of the decision of the general meeting or by the sole decision of the founder, on the basis of which a vacation order is issued, signed by the first person himself.

Step 2

In a situation where the issue of the procedure for granting leave to the first person is not spelled out in the company's charter, everything is easier. The director should not write a statement. He simply brings the desired dates for the rest into the general vacation schedule of employees on an equal basis with his subordinates.

Step 3

At the same time, two weeks before the vacation, he must be handed, against signature, a notice of the provision in accordance with the vacation vacation schedule on the dates set by that.

In the Labor Code of the Russian Federation, there are no recommendations from whom this notification should come. So it can be signed by the head of the HR department or any other employee in charge of the preparation of this documentation.

The manager is only required to sign a notice, appoint himself a replacement for the duration of the vacation and carry out this by order, and in due time go on vacation.
