An income statement is one of the documents that any employer, including individual entrepreneurs, must issue at the request of employees. To get help, you should contact the entrepreneur directly with a written application.
Labor law sets out certain rules for obtaining work-related documents by any employee. These rules apply to all employers, including firms and individual entrepreneurs. That is why the only difference when obtaining a certificate of income from an individual entrepreneur is the need to contact not the personnel department, but directly to the entrepreneur. It is best to prepare a written application in advance, which will indicate the date of the appeal, a list of documents that the employee requests are given. The income statement is a document directly related to work, therefore, the general procedure for issuing it applies to it.
How is income statement issued?
To obtain a certificate of income, an employee should contact the entrepreneur with a corresponding statement. Some individual entrepreneurs with developed activities have their own personnel workers, which allows you to contact them. It is better to submit the application in writing, since the employer may ignore or simply forget about the oral appeal. The application itself is written in the name of the entrepreneur (even when submitting to the personnel officer), it contains a request to issue a certificate of wages, the date of compilation and the personal signature of the employee. The certificate must be issued to the employee free of charge within three working days from the moment he submits such an application. In this case, the specified document must be duly certified (signed and stamped by the entrepreneur).
What to do in case of refusal to issue a certificate?
If the application is filed properly, and the entrepreneur does not issue a certificate, then the employee can file a complaint with the supervisory authorities or force the individual entrepreneur to issue this document in court. Usually, such conflict situations do not reach, since filling out and certifying this certificate does not entail any additional costs for the employer. The exception is those cases when an employee requires a certificate after dismissal. His statements are often ignored, so the only way out is to contact the competent authorities. If the employee's labor activity has already been terminated, then you can not apply for the issuance of a certificate personally to the entrepreneur, but send it in a valuable letter with acknowledgment of receipt, a list of attachments to confirm the actual submission in the future.
