The presence of large debts for housing and communal services from residents of any apartment building significantly violates the interests of their neighbors. That is why the latter use various methods of dealing with debtors.
The problem of large debts for utilities has a negative impact not only on debtors and management companies, but also on the neighbors of those tenants who do not fulfill their obligations. That is why neighbors can use a set of measures aimed at encouraging debtors to pay the required amounts. So, at the pre-trial stages, neighbors participate in joint raids with specialists from management companies or representatives of the board of the HOA. The main purpose of such a raid is to talk with debtors, identify the reasons for the formation and non-payment of debt, proposals for a mutually beneficial solution to problems (debt restructuring, long-term installments, forgiveness of a penalty and other options).
The judicial stage of the fight with debtor neighbors
If the pre-trial stage, attempts to peacefully resolve the dispute did not lead to a positive result, then the management company applies to the judicial authorities, at the same time imposing a restriction on the use of utilities by debtors. Neighbors of debtors do not have the right to go to court on their own, but they can give oral and written explanations, be summoned to meetings as witnesses, and help ensure the appearance of debtors at the proceedings. As a rule, tenants are much more willing to fulfill their duties, trying to find a solution to the problem that has arisen in cases where pressure is exerted on them not only from management companies and government agencies, but also from neighbors.
Stage of enforcement proceedings
The stage of enforcement proceedings follows in the case when, in the course of court proceedings, the debtor also did not want to voluntarily settle the dispute, complete the case with an amicable agreement and gradually pay off the debt. In this case, the management company turns to the bailiffs, who are obliged to execute the court's decision on debt collection, delay compensation. Neighbors of debtors can significantly help collect debt at this stage, since they often know about the debtor's place of work, about the presence of certain property (car, other dwelling). If a preliminary search for the debtor is necessary, neighbors can provide information about the presence of relatives and friends. Such information significantly helps to promptly execute the court decision and effectively complete the fight with the debtor neighbors.
