How to calculate the day off

It is necessary

  • - application;
  • - calculator or program "1C Salary and Personnel".

Instructions

Step 1

In accordance with article 153 of the Labor Code of the Russian Federation, for work on weekends or holidays, the employer is obliged to charge and pay double wages if the employee does not express a desire to receive additional days of rest. In this case, all weekends and holidays, overtime work is paid in a single amount, the time off received is not payable.

Step 2

If an employee has submitted an application with a request to provide him with one or several days on account of the next vacation, pay according to the average daily earnings calculated for 12 months, unless otherwise specified in your internal regulations of the enterprise. Other instructions should not prejudice the legal rights of workers. This means, if your regulations specify that you pay for leave based on the average daily earnings for three or six months, the amount should not be less than the average daily earnings calculated based on the 12 months specified in the labor law.

Step 3

Make the same calculation if the employee wrote an application for time off for donating blood. To calculate, add up all the amounts earned for 12 months or according to the instructions of internal legal acts, divide by 12 and by 29, 4. Multiply the result by the number of days provided for vacation or for donating blood.

Step 4

Unpaid time off is provided at the request of the employee on the basis of article No. 128 of the Labor Code of the Russian Federation. This type of time off is not payable, therefore, do not make payments for the provided rest days.

Step 5

Any type of additional rest days or time off received at your own expense must be agreed with the employer, submit a written application, and receive a resolution under it. If an employee has the right to a day off, but did not approve and did not go to work on his own, this is equivalent to absenteeism, for which he can be fired.
