Step 1

First, you need to write a statement of claim. You can do this in simple writing or in print. The law does not provide for strict restrictions. Take care of the preparation of documents that will be an attachment to the application. First of all, this is a receipt for payment of the state fee. In addition, you will need copies of the statement of claim on the number of participants in the case, a power of attorney if another person (lawyer, relative, etc.) will represent your interests in court. The rest of the documents will need to be selected depending on the subject of the appeal (marriage certificate, calculation of the amount of the claim, etc.).

Now move on to preparing blocks of information that you may need when drafting a claim. Find out which court will have to consider your appeal. As a rule, this is a site serving the area of your residence, but it can also be at the place of registration of your opponent. Its number will need to be indicated in the introductory part of the application.

This is followed by the requisites of the plaintiff and the defendant (name, address, contact numbers). It is also recommended to indicate the amount of the claim here. In the substantive part of the claim, describe the essence of the case and the circumstances in which your rights were violated. List the evidence you have. Contact the court with a request to recognize your claims against the defendant as justified and provide specific articles of the law that allow you to count on a positive decision. Finally, list in the "Appendix" paragraph all the documents that will be submitted to the court along with the statement of claim.

Step 5

Submit the signed application along with the set of attached documents to the office of the court department. The court will issue a determination to accept your application and set a date for a hearing.
