The arbitration court considers economic disputes, as well as other cases related to the implementation of entrepreneurial and other economic activities, disputes arising from administrative-legal and other public relations in the same area, other cases referred to the competence of arbitration courts.
Instructions
Step 1
Before filing a claim with arbitration, file a claim with the other party. It must be sent by registered mail with a simple return receipt.
Step 2
Then file a statement of claim with the arbitration court. Individual entrepreneurs need to indicate the date and place of state registration.
Step 3
Attach the following documents to the statement of claim: a copy of the agreement, copies of the statement of claim and claims sent to the other party, copies of the certificate of state registration as a legal entity or individual entrepreneur, documents establishing the circumstances on which the claim is based. Do not forget to send a copy of the statement of claim and the accompanying list of documents to the defendant.
Certify copies of all documents with the seal of the organization and the signature of an authorized person or at a notary.
Step 4
Attach a receipt or a copy of the payment order for payment of the state duty, a copy of the receipt for sending the claim and statement of claim to the other party by registered mail with acknowledgment of receipt, a power of attorney to the plaintiff's representative and copies of an extract from the Unified State Register of Legal Entities and USRIS.
Step 5
The claim is filed with the arbitration court at the location of the defendant. If the defendant's address does not match the address indicated on the documents, then specify the legal address by requesting the Federal Tax Service of the Russian Federation.
Step 6
Submit them to arbitration by submitting them to the office or send them by mail or to the e-mail address of the arbitration court. You can find out about the progress of the case on the website of the arbitration court, where the documents were submitted.
Step 7
Remember that the statement of claim will be rejected by the court if the general rules for filing and submitting such statements are not followed. The litigation in an arbitration court can drag on for 2-4 months. Taking into account the appeal, the period for considering the case and making a decision may increase.
