Regardless of the type of activity that a particular company is engaged in, its management faces a choice: who to hire. Often, entrepreneurs employ foreign workers, which can be attributed to several factors. First, a foreign employee may have a much better level of training. Secondly, many foreigners are just cheap labor.
Instructions
Step 1
In order to attract foreign workers, obtain an appropriate permit. This is stipulated in paragraph 4 of article 13 of the Federal Law of July 25, 2002 No. 115-FZ "On the legal status of foreign citizens in the Russian Federation."
Step 2
The only exceptions are workers, for whose arrival on the territory of Russia a visa is not required.
Before obtaining a permit for employment by foreign persons, you have to obtain a quota, if such is established by the Government of the Russian Federation in clause 6 of clause 13.1 of article of the aforementioned law.
Step 3
To obtain a quota and determine its size, write an application in which you describe your need as an employer to attract foreign labor. Submit this document to the executive bodies of state power. All the powers assigned to this body are written in the decree of the Government of the Russian Federation of December 22, No. 783.
Step 4
If you want to know in advance how many foreign workers you can attract, take a look at the corresponding decree of the Government of the Russian Federation, which sets the total number of quotas for issuing permits to foreign citizens.
Step 5
Also see the Order of the Ministry of Health and Social Development of Russia, in which the total number of quotas is broken down by category, profession, qualifications and specialties. So select the required item, and you will be able to find out the maximum possible number of foreign citizens in this position. Remember that one employer can hire an unlimited number of people within a predetermined quota.
Step 6
In the event that a foreign worker arrived in Russia in a visa-free regime, you do not need to apply for a quota. Submit to the FMSRF authority and the employment authority a notice of the conclusion of an employment contract with a foreigner holding the appropriate permit, and continue your activity.
