Sometimes you can hear the opinion that building your own house is much easier than issuing all the necessary documentation for it, without which it is impossible to obtain a certificate of ownership. In fact, this is not the case - with the entry into force of the Urban Planning Code of the Russian Federation in 2005, the procedure for registering a built house in ownership has become much easier.
Instructions
Step 1
According to part 3 of article 48 of the Civil Code of the Russian Federation, in the case when a house is intended for one family and its height does not exceed 3 floors, project documentation is not required for it. Therefore, from the start of construction to the preparation of a package of documents for state registration of a real estate object, you will need to issue:
- urban planning passport for the land plot;
- the scheme of the planning organization for the land plot;
- permission to build a house;
- technical conditions for connecting utility networks;
- cadastral passport of the object of individual housing construction;
- permission to put the IZhS facility into operation;
- a certificate of assignment of a postal address.
Step 2
A town planning passport and a planning organization diagram for a land plot are required to obtain a building permit. A town planning passport must be ordered from the territorial body of architecture and town planning at the location of the land plot. The layout of the planning organization is a topographic plan of a scale of 1: 500, on which the boundaries of the site, the location of the house under construction and the communications available in fact are plotted. It must be ordered from a design organization that has an SRO approval.
Step 3
With a city planning passport and a diagram in hand, write an application addressed to the head of the local administration with a request to issue you a permit for the construction of an individual residential building. The package of documents will also need to attach a copy of a civil passport and documents of title to the land plot. The permit must be issued within 10 working days and is valid for 10 years.
Step 4
You will receive technical specifications for the connection of utility networks in those organizations on the balance sheet of which the backbone networks to which you plan to connect are. When the construction is completed, it is necessary to issue a permit for commissioning in the architecture and urban planning authorities. After that, you should write an application to the administration of the village with a request to assign a postal address to your house.
Step 5
Having on hand documents for the land, a decree on the commissioning of a house and a certificate of assignment of a postal address to it, you can apply to the territorial bodies of Rosreestr with an application for registration of a real estate object - an individual residential building and receive a Certificate of ownership of it.
