No matter how people strive to avoid problems and troubles in their lives, sometimes there are cases when it is possible to protect their interests only in court. You can't just come and tell the judge that your rights have been violated. You need to go to any court in the form established by law.

Instructions

Step 1

The procedure for applying by citizens with statements, complaints, petitions to a district court is regulated by the Civil Procedure Code of the Russian Federation. Also, additional information, relevant regulations and some sample documents can be found on the official website of the court you want to contact.

Step 2

The statement of claim must comply with the conditions set forth in Article 131 of the Code of Civil Procedure of the Russian Federation. It must contain the name of the court, the plaintiff and the defendant, their contact details (registration address or actual place of residence). Indicate these data correctly, they are needed not only in order to more accurately identify the parties. During the trial, workers may need to contact you with important information.

Step 3

In the main part of the application, indicate exactly how and under what circumstances your rights were violated, provide facts confirming this. If the claim is to be assessed, clearly define its price, explain how it came together. If the law provides for an out-of-court dispute resolution procedure, indicate that it was followed. List and attach copies of documents that can be used in the case to support your words.

Step 4

In the requesting part of the application, clearly indicate, point by point, what you expect from the trial. Make sure the number of copies of the statement of claim matches the number of participants in the case. Pay the state fee and go to the district court office. Give the employee all copies of the claim for the participants in the case, leaving one copy for yourself. It will be marked by the court on the acceptance of documents.

Step 5

In cases where you submit other documents, it all depends on the specific circumstances. All statements, petitions and other documents on an already ongoing case are drawn up in the name of the judge leading the process. They are transferred either to the judge himself during the session, or to an assistant, or to the office in the usual way. In any case, it is better to keep a copy of the document with a court mark. The content of the statement must be logical and clear.

Step 6

If you want to file a complaint against a court employee, address it to the President of the Court. If you have problems with the judge who is in charge of your case, it is better to contact the Qualification Collegium of Judges at the Supreme Court.
