Enforcement proceedings based on a court decision begin only from the moment when you present a writ of execution to the bailiff service and it will be accepted. The bailiff is the executor to initiate enforcement proceedings, which will be carried out on the basis of your application and all the necessary annex documents.

Instructions

Step 1

Contact the appropriate bailiff service and take 2 application forms or a sample of its filling there. Such a statement is written in free form, but some general rules must be followed. If you are not writing it on letterhead, then use a standard sheet of white paper. In this case, the application must be submitted in printed form so that its text is legible and easy to read.

Step 2

In the upper right corner, write the name and address of the bailiff service. Step back a little and also, on the right, write after the word: "Claimant:" your last name, first name and patronymic, indicate the address of residence and telephone number for contact. Make another indent and after the word: "Debtor:" write the surname, full name and patronymic of the person in whose name the writ of execution is issued. Enter the debtor's address.

Step 3

Write the title of the document, departing from the address part 1 cm. Place its title: "Application for the initiation of enforcement proceedings" in the middle of the line.

Step 4

State the introductory part of the application briefly, with reference to the details of the court case. Do not forget to write his number, surnames and initials of the claimant and the debtor, the amount of recovery. Immediately write the date of issue of the writ of execution, its series and number.

Step 5

In the main text, state the request to recover the specified amount from the debtor, indicate again his residence address. List the details of your personal bank account to which the collection amount should be transferred. These details are the full name of your bank, its correspondent account, BIC, TIN, and your account number.

Step 6

Additionally, you can also indicate the address of the debtor's immovable property and ask to seize it, so that if it is impossible to collect funds, it was made at the expense of this property.

Step 7

Finally, refer to Art. 67 and part 2 of Art. 30 of the Federal Law "On Enforcement Proceedings" and ask for a resolution to temporarily restrict the debtor's departure from the territory of the country.

Step 8

As an attachment, indicate the writ of execution to which you refer in the text of the application. Don't forget to attach it to your application. Put your signature, give it a transcript, put down the date. Send the application by mail, by registered mail with return notification and enclose a list of documents in the envelope. If you wish to submit your application in person, please put a note on the second copy at the secretariat that it has been accepted.
