Harmful working conditions are those working conditions that can cause some harm to the health of the employee. In accordance with the labor legislation of the Russian Federation, a person working in such conditions is entitled to some compensation.

Step 1

First of all, an employee carrying out his labor activity in hazardous conditions is entitled to cash surcharges. They are set in excess of the normal salary and the wage rates for work under normal conditions. The amount of such additional payments is indicated in the employment contract and is discussed in advance by the employee and the employer. In addition to these additional payments, the employee is entitled to some compensation. As Art. 219 of the Labor Code of the Russian Federation, the amount of compensation is approved by the Government.

In accordance with Art. 164 of the Labor Code of the Russian Federation, it is customary to refer to compensations as cash payments, which are intended to reimburse the employee for those costs that are associated with the performance of his labor duties provided for by the current legislation.

Step 3

There are several types of compensation that are due to an employee performing his duties in hazardous working conditions. These include increased wages (Article 147 of the Labor Code of the Russian Federation), annual additional leave with appropriate pay (Article 117 of the Labor Code of the Russian Federation), reduced working hours (Article 92 of the Labor Code of the Russian Federation).

Step 4

According to the Decree of the Government of the Russian Federation of November 20, 2008 No. 870, the reduced duration of working hours provides for an employee to perform his job duties no more than 36 hours a week. Additional paid annual leave must be at least 7 calendar days, and the remuneration of such an employee must be increased by at least 4% of the salary (tariff rate) established for performing various types of work in normal working conditions.

In addition, if an employee performs his duties in working conditions that can cause some harm to his health, he has the right to additional food (enterprises most often give their employees milk or other similar products), by agreement between the employee and the employer, these products can be replaced by monetary compensation corresponding to the value of these products.

Step 6

Also, the employer is obliged to provide an employee performing his work in harmful or hazardous working conditions, special personal protective equipment.
