A collective agreement is a legal act that defines social, labor and other similar relations between employees and the employer. Like any document, it can be supplemented and changed. If the procedure for amending the collective agreement is not spelled out in the collective agreement itself, then the provisions established by the Labor Code of the Russian Federation apply.
Instructions
Step 1
A proposal to start collective bargaining in writing:
- initiator, employer - a letter to the employee representative (trade union leader, chairman of the labor collective council, representative of the general meeting of employees, and others);
- the initiator of the labor collective - a letter to the employer with the attachment of a document confirming the community of the initiative (minutes of the general meeting with a majority of votes).
Step 2
A written response from the other party, indicating the representatives and their powers.
Step 3
Creation of a commission.
Issue by order of the head. It is advisable to include a personnel officer, a lawyer, a representative of employees, and appoint a deputy head as a chairman.
Step 4
Formulation by the commission of amendments to the collective agreement and its signing by the parties.
Step 5
Registration of changes in the labor authority, term - seven days.
