It happens that it is necessary to discharge a person from the apartment if he does not live there or interferes with his roommates. This can be done even without his consent in several ways.

Step 1
Discharge Father through the Courts Your homeowner mother may discharge your father from the apartment through the courts after divorce if she is married to him. This is indicated in the Housing Code of the Russian Federation (Article 31, Part 4). This is provided that the father does not have ownership of the home. If he has nowhere to be discharged, the court may leave the further residence of the father in the same place of residence for a specified period. At the end of this period, the father must leave the place of registration.
Step 2
Sell housing together with a man registered in it The Civil Code of the Russian Federation (Art. 292, clause 2) states that when the ownership of housing is transferred, family members of the previous owner lose the right to use the premises. Thus, in order to discharge your father without his consent, you can sell the house, and the new owner will deal with his discharge in court himself. You just need to find a buyer who will agree to this. And, most likely, you will have to lower the price of your home.
Step 3
Go to court if the housing is owned by the state According to the Housing Code (art. 83, parts 3 and 4), if you or another family member is a tenant, then when you move to another place of residence, the social tenancy of the dwelling is terminated. If your father is the tenant, then the contract can be terminated through the court for the following reasons: if he does not pay for housing for more than six months, damaged the dwelling, interferes with neighbors, or uses municipal property not for housing.
