Step 1

The place of residence of a child under 14 years old, according to Article 20 of the Civil Code, is the place of residence of his parents or other legal representatives. Moreover, for the implementation of this provision, an exception has been made in the rules on registration of citizens. Thus, the consent of the owner of the residential premises is not required if the registered parent needs to register his minor child in the same premises.

Thus, from the permitting documents, the mother only needs to have her own passport with registration on hand. Moreover, this registration must be mandatory at the same place of residence at which the child must be registered. In addition, the child's birth certificate must be available.

Step 3

With the indicated documents, come to the passport office of your area. Write an application of the established form to register your child at your place of residence. Fill out the arrival form for it. If the child is currently registered in a different place of residence, fill in the departure form at the same time. When registering, it will be automatically removed from the register at the old address and registered with a new one.

Step 4

Submit all specified documents to the passport office employee. Registration of the child will be carried out within a period not exceeding 5 days.

Often, without the presence of the second parent, the FMS authorities verbally refuse to register children. This refusal is illegal. In this case, write a written application addressed to the head of the district FMS. Please report the verbal refusal you received and indicate your child's prompt registration requirement.

Step 6

To date, a sufficient number of court decisions have been issued obliging the FMS to register children without the participation of the second parent. Therefore, in most cases, a positive response is received to a written appeal to the FMS, and the child is registered at the mother's place of residence.

Step 7

If you have received an official written refusal from the FMS to register a child due to the lack of consent of the second parent, go to court with a claim. Indicate your district FMS as the defendant in the claim. The court will defend the interests and rights of the child and, as a result, oblige the FMS to register the child at your place of residence.
