When we are faced with material losses due to the fault of other people, the amount of damage is significant, and the perpetrator of the problems refuses to compensate for losses, there is only one thing left - to go to court with a statement of claim. Registration of such an appeal must comply with the requirements of the procedural legislation of the Russian Federation and must contain a number of mandatory details. Step 1

Start filling out the statement of claim according to the rules by filling in the initial details in the upper right corner. First of all, this will be the name of the court to which you plan to apply to protect your interests. Next, indicate the full details of the plaintiff and the defendant (surname, name, patronymic, place of residence and contact numbers). Here you can also write the details of the witness on your side. The last point here is to indicate the full amount of the claim. Place the title of the document "Statement of Claim" in the center of the sheet and immediately below it, explain briefly the content of the appeal "for compensation".

Step 2

In the descriptive part of the application, indicate the circumstances of the case, which became the basis for going to court. Provide evidence supporting the validity of your claims, substantiate them with references to regulatory documents and specific articles of the Law.

Step 3

Provide in the text of the application the calculations that allow the amount of damage declared in the claim to be presented to the defendant for compensation. Tell the court about your attempts to reach an agreement with the defendant in the pre-trial order, indicating the specific dates of the negotiations and the defendant's refusal to reimburse the damages.

Step 4

In the final part of the statement of claim, list your requirements against the defendant and state your request to the court to protect your interests, starting your appeal to the court with the word "Please".

Next, list all the documents attached to the application (acts, copies of contracts, calculations, a receipt for payment of state fees, etc.).

Sign the statement of claim with your own hand and date it.
