If your health or property has been damaged, then the guilty person is obliged by law to compensate you for all losses. You have the right to demand both material compensation and compensation for moral damage. In order to go to court, you must correctly draw up a statement of claim.
Instructions
Step 1
Write in the upper right corner of the blank sheet the name of the court to which you will be applying. Please provide information about the plaintiff and the defendant below:
- surname, name, patronymic of the plaintiff, address of the place of residence;
- if the plaintiff is an organization, then its name and address;
- if the plaintiff is a representative of the victim, then his name and address;
- the name and initials of the defendant, the address of the place of residence;
- if the respondent is an organization, then its name and address.
Step 2
Write down the name of the document in the center of the line "Claim for damages".
Step 3
On a new line, indicate what exactly, in your opinion, is the violation of rights, freedoms, and legitimate interests. Describe in detail the circumstances of the incident that led to the injury caused by the defendant. Provide evidence of violation of your rights and freedoms (sales receipts, invoices, certificates of the state automobile inspection, contracts, extracts from the medical history, examination protocols, etc.).
Step 4
Record a detailed calculation of the disputed amount. Indicate what additional costs you have incurred to restore your rights and legitimate interests (cell phone costs, payment for drugs, postage, etc.).
Step 5
Reflect in a separate paragraph the fact of pre-trial appeal to the defendant, if any.
Step 6
Write on a new line "In connection with the above, PLEASE:", list the requirements put forward by the respondent. Indicate the amount of monetary compensation for material losses and, if necessary, compensation for moral damage.
Step 7
Make a list of attached documents, copies, certificates, etc., mentioned in the statement of claim.
Step 8
Indicate, if you deem necessary, phone numbers, fax numbers, e-mail addresses of the defendant and the plaintiff, as well as any other information that is relevant when considering the application. Sign and date the statement of claim.
