The conditions for the justified use of weapons by citizens of the Russian Federation are enshrined in a special federal law. It should be borne in mind that in all cases of such use, the weapon must be in the possession of a person legally.
Justified is such use of weapons, which is committed by a citizen of the Russian Federation in a state of extreme necessity, necessary defense. In this case, the weapon must be in the possession of the person using it on a legal basis, and the purpose of use must be to protect life, health, property. Before using a weapon, a clear warning of the person against whom it will be used must be followed. It is possible not to make such a warning only if any delay creates a danger to the lives of people, can lead to other serious and irreversible consequences. If a weapon is used against a specific person by a person in a state of necessary defense, then a prerequisite for legality is the absence of harm to any other persons.
Prohibitions related to the use of weapons
The use of weapons is not recognized as justified when it is carried out against women, minors or those persons who have outward signs of disability. The only exceptions are cases of mass or armed attacks by the listed categories of citizens. Even if there is a right to carry a weapon, it is forbidden to carry it with those persons who take part in any mass events. In this case, the nature of the public event is not decisive, since the prohibition applies to meetings, processions, demonstrations, sports, entertainment and other events.
Other features of the use of weapons
In the presence of a weapon on a legal basis, a citizen must take into account the existence of a ban on its exposure. This prohibition applies to all cases, except for the situations indicated above, in which the use of weapons is considered justified. If the weapon was nevertheless used, then the person who used it is obliged to report this circumstance to the law enforcement agencies. In this case, the message should be made to the police department located at the place of use of the weapon, and the maximum period for the transfer of such information is a day from the date of use of the weapon. It should be borne in mind that extreme necessity, necessary defense are those circumstances that, if confirmed, exclude the criminality of the act. That is why, when using a weapon in these circumstances, a person is not brought to criminal responsibility.
