Dismissal for absenteeism is a very unpleasant event for any employee. However, not going to work can have really objective reasons. Let's look at a few examples on this matter.

The first example: not going to work in connection with an administrative arrest imposed on an employee by a court. Given that the reasons for the imposition of such a penalty do not relate to the employment relationship between the employer and the employee, serving an arrest is considered a valid reason to be absent from work. The courts conclude that, in this case, the absence from work is not associated with evasion from the performance of labor duties.

Example two: an employee did not come to work because he donated blood as a donor. Indeed, the law provides for an additional day of rest after donating blood and its components. However, we are talking about one calendar day, that is, a day. Therefore, if the end of the worker's shift falls on the next day, his absence from work during the entire shift is considered absenteeism. The courts say that the day of rest is given without reference to the work schedule. Moreover, this day should be used immediately after donating blood, it is no longer possible to use it later.

Example three: a part-time worker did not show up for work because he was on a business trip to the established place of work. Since part-time jobs are work in their free time from the main job (Article 282 of the Labor Code of the Russian Federation), such a business trip is an objective and valid reason for being absent from work.

Example four: the employee was not at work due to being investigated the fact of an accident. Considering that it is his responsibility to give explanations on the fact of an accident, in which the employee became a participant, dismissal for absenteeism in this situation will be illegal.
