According to the Land and Town Planning Codes of the Russian Federation, each land plot has a designated purpose, in accordance with which its use should be carried out. The boundaries of the plots, their categories and the town-planning regulations in force on them are determined by the Land Use and Development Rules (LZZ), which from 1.01.2012 must be adopted for each settlement.

Instructions

Step 1

Prior to the adoption of the PZZ on the territory of the settlement, there is a general procedure that determines the procedure for changing the type of permitted use of a land plot.

Step 2

The change in the type of the permitted plot is carried out through the organization of public hearings with the participation of citizens who live within the territory of the given administrative unit, within the boundaries of which the plot is located. In the event that a new type of use can negatively affect the environmental situation, the rightholders of capital construction objects and land plots that are in the predicted risk zone should take part in the hearings.

Step 3

After filing an application from an interested person to change the permitted use of the site, on the basis of the decision of the head of the district or settlement administration, a commission is created. Her responsibilities include sending messages about holding public hearings to all copyright holders and interested parties. Usually, information about upcoming hearings is sent to the media.

Step 4

Participants in public hearings draw up their proposals and comments and send them to the commission for inclusion in the minutes of the public hearings being held. The results of the public hearings will also be published in the media and on the Internet. The timing of public hearings and the publication of their results are determined by the Charter of the municipality, they should not be more than 1 month.

Step 5

Based on the results of public hearings, the commission prepares recommendations on changing the type of permitted use of the land plot to the head of the municipality, who, within three days, makes a decision to approve or reject this change. The decision made becomes a legal basis for making appropriate changes to the state land cadastre and the Unified State Register of Rights to Real Estate and Transactions with It.

Step 6

After the adoption of the PZZ, this procedure is simplified - all land plots and capital construction objects located on them, their use and purpose will have to comply with the regulations established in the PZZ, which determines the types of permitted use and limit values for the size of capital construction objects.
