Step 2

If one of the former spouses, who is registered in a municipal apartment, does not live there for a long time and does not pay for utilities, you will not be able to write it out only on this basis. According to article 71 of the Housing Code of the Russian Federation, a family member temporarily not living in an apartment does not lose his right to use it.

Step 3

If your apartment is not privatized, you have the right to forcibly exchange it. According to Articles 90 and 91 of the Housing Code of the Russian Federation, if the tenant does not pay for utilities within six months, he and his family will have to leave the apartment.

Step 4

If the marriage is dissolved, the former spouses do not lose the right to use the living space. You can only release a tenant if your ex-spouse agrees to do so.

Step 5

If the apartment was purchased by you before marriage, in accordance with Article 31 of the Housing Code of the Russian Federation, you can easily check out your former spouse from the living space.

Step 7

If you want to check out a tenant from an apartment that was donated to you, and a person has already been registered in it, go to court. This issue will be dealt with there. And it is the court that will decide the issue of eviction. A child under the age of 14 can be discharged through a court or by agreement with a parent. This issue is always considered by the guardianship authorities as well.
