Many state institutions and structures, as well as the authorities of the constituent entities of the Russian Federation, are endowed with the rule-making right - to change existing and develop new normative acts: laws, presidential decrees, decrees, etc. Therefore, it is not surprising that legislation is constantly changing and in order to act in accordance with it, you need to know from what moment changes and new laws come into force.

Step 1

Article 15 of the Constitution of the Russian Federation, which is the main law, establishes that all laws applied in the country are subject to mandatory publication. The same applies to any normative legal acts affecting the rights of citizens guaranteed by the Constitution. In accordance with its rules, normative acts unpublished for general information cannot be applied. But the term for the entry into force of laws depends on its type and the rule-making body that developed it. If the text of the law itself does not indicate the date from which it is considered valid, it is necessary to determine the moment of its entry into force in accordance with the rules established by laws and other normative acts.

Thus, Federal Law No. 5-FZ on June 14, 1994. sets out for federal constitutional laws 10 days after they were officially published. And they must be published no later than 7 days after they were signed by the President. This procedure applies in all cases when the law itself or other by-laws of the Upper or Lower House of Parliament does not set a different starting date for this law. There are three official media outlets entrusted with the honor of publishing constitutional laws: Parlamentskaya Gazeta, Rossiyskaya Gazeta and Collection of Legislation of the Russian Federation. But the Decisions of the Constitutional Court come into legal force immediately after they have been adopted.

In accordance with Article 23 of the Constitutional Law No. 2-FKZ of December 17, 1997, the decisions and orders of the Government of the Russian Federation come into force after they were published for the first time in one of the above-mentioned official publications. These documents must be published no later than 15 days after they have been accepted. Resolutions of the government of the Russian Federation, affecting the rights and freedoms of citizens guaranteed by the Constitution, begin their official effect only 7 days after they were published for the first time.

Step 4

For acts of the President and the Government of the Russian Federation, in accordance with the decree of the President of the Russian Federation No. 763 of May 23, 1996, publication in official publications is considered the moment of entry into force. Normative acts and decrees of the President begin to operate simultaneously throughout the country a week after they were first published. Acts of the President and the Government of the Russian Federation, which contain information belonging to the category of state secrets or having a confidential character, enter into force immediately after they are signed.
