Compliance with traffic rules is the most important requirement for its participants, which serves as a guarantee of road safety. One of the provisions of the traffic rules is the prohibition on the transfer of vehicle control, which is applied in specific cases.

Transfer of vehicle control to another person may in some cases be justified, however, the current Road Traffic Regulations provide for a prohibition on such transfer under certain conditions.

Situations in which control transfer is prohibited

A complete list of situations in which the driver is prohibited from transferring the right to drive a vehicle to another person is described in paragraph 2.7 of the current Road Traffic Regulations. The specified section of the document establishes that the implementation of such a transfer is not allowed in cases where the person to whom the steering wheel is transferred is in a state of alcoholic or drug intoxication or under the influence of potent drugs, as well as to those citizens who do not have a driver's license with them that allows driving a car of this category, or another document that serves as its full replacement.

Punishment for unlawful transfer of control

The sanctions that can be applied to a driver who has carried out an unlawful transfer of the right to drive to another person, as well as other sanctions for violation of the Traffic Rules, are spelled out in the Code of Administrative Offenses of the Russian Federation, registered in the code of laws of our country under number 195-FZ of December 30 2001 year. It is noteworthy that although the current Traffic Rules do not share different grounds for the illegality of transferring the right to drive a car, the Administrative Code provides for different punishment for different types of such violations.

So, when transferring the steering wheel to a person who does not have a driver's license with him, the car owner will have to pay a fine of 3 thousand rubles (paragraph 3 of Article 12.3 of the Administrative Code of the Russian Federation). And this, it must be admitted, is one of the mildest punishments provided for the unlawful transfer of control. In particular, this situation applies only to persons who, in principle, have such a certificate, but, say, have forgotten it at home. If the person to whom the steering wheel was transferred does not have a certificate at all, since he never received it or was deprived of it, the owner of the car who transferred him the right to drive will pay a fine of 30 thousand rubles (paragraph 3 of Article 12.7 of the Code of Administrative Offenses of the Russian Federation). A similar amount of the fine will be imposed on the owner who entrusted a person in a state of intoxication to drive the car. However, in this case, an additional punishment will be applied to him in the form of deprivation of the right to drive a vehicle for a period of one and a half to two years (paragraph 2 of Article 12.8 of the Administrative Code of the Russian Federation), since such an act is associated with the creation of an increased danger for other road users.
