Many workers and employers do not know about the shortened pre-holiday day, and in fact such a norm not only exists, but is also regulated by labor legislation. How much is the working day shortened before the holiday and in what cases does this rule apply?
What is a shortened work day before a holiday?
An abbreviated day precedes a public holiday. According to article 95 of article of the Labor Code of Russia, the working day on the eve of the rest should be reduced, but this should not affect wages in any way. A similar benefit applies to the following groups of employees:
- working in 5/2 mode;
- working in 6/1 mode;
- issued for a shortened or part-time working day;
- included in the main state as part-time workers.
It is impossible to reduce the time of work where there should be a constant continuous activity related to the specifics of production. Employees at such enterprises are not entitled to a shortened day, but they are paid extra for processing several hours or compensated in some way (at the employee's choice). According to article 95 of part 3, employees can take time off or money, which is charged as overtime.
How many hours does the reduction take place?
According to Part 1 of Article 95, the reduction occurs by one hour - this is the norm for both employees and employers. The norm applies even if the employee is acting part-time.
That is, even if the working day is 4, not 8 hours, the working time will still be reduced by one hour. The same rule applies to those who work one hour - they have a day off.
In what cases the day is shortened, and in what cases it is not
If the day before the holiday falls on a weekend, the schedule will not change, that is, there will be no reduction.
In order to determine the days and abbreviations, you can study the production calendar. In it, the dates of the pre-holiday days are marked with asterisks. Additionally, you can find out about the postponed weekend.
Registration of the pre-holiday day in the TC of Russia
According to part 4 of article 91, the employer must keep track of the hours worked by filling out the T-12 or T-12 form. He can also draw up his own form without a form, if it contains all the required details. Otherwise, everything is the same - in the time sheet, the working time is reduced by 1 hour. The question is, is it necessary to issue an order?
Since in TC the days before the holidays are regulated in the same way as ordinary days, you do not need to issue the corresponding order and order. But, if the employer wants to write an order to shorten the day, this will not be superfluous, like a simple announcement. When it comes to continuous production, workers must decide who will leave first and who will stay until the end.
