Registration of an application for an invention means the procedure for the preparation and filing of documents for the grant of a patent for an invention and the establishment of copyright. The application can be filed both by the author personally and by his assignee, or through the organization in which the invention was developed and tested.
Instructions
Step 1
Submit your application to the federal executive agency for intellectual property. This can be done in person, by mail or fax, or through a patent attorney.
Step 2
If you decide to apply for several inventions, you must prove that they can only be applied jointly. The main condition for the correct preparation of an application is compliance with the requirement of unity of invention.
Step 3
If the application is filed through an organization, then documents must be drawn up on the participation of each of the co-authors in the creation of the invention and on the possibility of open publication of information (for example, an examination report).
Step 4
The documents accompanying the application are a receipt for payment of the patent fee in the established amount (or a document defining an exemption from its payment or a deferral); certified copies of the first applications (if filed by the applicant for the patent). If the author of an invention undertakes to assign the rights to his invention to another natural or legal person in the event of obtaining a patent, he must write a statement about this, which is also attached to the application.
Step 5
Submit your application in Russian. Accompanying documents can be submitted in another language, but they are accompanied by their translation into Russian.
Step 6
Prepare three copies of the package of documents in Russian. Documents drawn up in another language must be submitted in one copy.
Step 7
If you sent your application by fax, do not forget that the deadline for submitting original documents is one month from the date of their receipt by fax.
