A mother, father or close relatives can apply for maternity leave to take care of a child (Federal Law No. 81-F3, Article No. 15, Article No. 256 of the Labor Code of the Russian Federation). In order to receive maternity leave for the father, the employer must present an application and a package of documents on the basis of which the allowance will be calculated.

Step 1
If the child's mother, for some reason, cannot take care of him, the father has every right to receive leave from work. Up to one and a half years, the employer is obliged to calculate and pay benefits in the amount of 40% of the average earnings for 24 months. From one and a half to three years, the allowance is not paid, but the father has the right to care for the baby up to the specified age.
Step 2
To apply for parental leave, contact your employer with an application. Submit a separate application asking for parental leave up to one and a half years old and from one and a half to three years.
Step 3
In addition to the application, you must submit a certificate from the place of work or study of the child's mother that she does not use this type of leave. If the mother is sick, present a certificate from a medical institution confirming this fact. You will also need a baby's birth certificate and a photocopy.
Step 4
Based on the submitted documents, you will be credited with an allowance. If you worked for different employers, get a certificate of income and present it at your main place of work, since you have the right to receive 40% of all income for 24 months from which income tax was withheld from you and transferred to the budget. But at the same time, the maximum amount of payments cannot exceed 13,833.33 rubles, the minimum cannot be lower than 2,194.33 rubles for caring for the first child and 4,388.67 rubles for caring for a second or two children.
Step 5
The benefit begins to accrue from the next day after the end of maternity leave. Payment is made on the day wages are issued, which is established by the internal regulations of the enterprise.
Step 6
The employer does not have the right to refuse to grant a parental leave to a father. If you still received a refusal, appeal it in accordance with the procedure established by law by contacting the labor inspectorate or the court.
