Late payment of wages is a very common problem these days, from which many workers suffer, and which employers actively use. If you find yourself in the place of a person who has not been paid salaries for several months, do not sit still - defend your rights in all possible ways. The more actions you take, the more likely it is that the employer will simply have to pay you wages to avoid losing your reputation or losing employees.
Instructions
Step 1
The Law "On the Protection of Wages" establishes certain terms for the payment of wages, namely, the employer must pay wages by the tenth day of the month that follows the worked. Therefore, if after the onset of this deadline, your salary has not been paid to you, take action.
To begin with, contact the employer himself directly with a written request, in which you indicate that you insist on the payment of your wages in full and compensation for the delayed deadlines. Such a move, of course, does not always work, so most likely you will have to move on.
Step 2
File a formal complaint with the Department of Social Security at the Labor Compliance Office. The employees of this organization will tell you exactly what documents you need, and what you can count on specifically in your situation.
Step 3
If, after contacting social security, the situation remains the same, use the legal right of the employee, whose rights and legitimate interests have been violated by the employer, and go to court. To do this, come to the World Court, taking with you a statement, a photocopy of your work book and a certificate that confirms that you are not paid wages. Delay in salary payments is a serious problem that needs to be addressed as soon as possible, because it is in your own interests. Within five days, the Justice of the Peace will make his decision to recover the amount of money from the employer who is holding back wages in your favor. After that, the case is transferred to the bailiff service. The bailiffs within 10-14 days will withdraw the funds that were intended for you from the debtor's bank account and transfer them to your personal account or card.
Step 4
In addition, the prosecutor's office also deals with cases of delays in the payment of wages. Go there with an official document confirming your position and get the employer to be summoned to court.
