An employee of the organization went on vacation. Often there is a production need to recall an employee from vacation, or force majeure circumstances do not allow the employee to go on vacation. Step 1
If you withdraw a vacation application from the employer's position, be sure to obtain the employee's written consent to withdraw from the vacation. In order to withdraw an employee's application from vacation, good reasons or industrial necessity are needed. If you, as an employee, want to pick up an already signed vacation application, you need to write an application in any form addressed to the head of the organization with a request to postpone the date of the next vacation.
Step 2
To cancel the vacation order, the following conditions must be met: - written justification for the cancellation of the order or the employee's statement; - written consent of both parties; - order to cancel the vacation order with justification. After the cancellation of the vacation order, the employee makes the received vacation pay to the cashier of the enterprise.
Step 3
If the order is canceled during an employee's vacation, the employee's recall is evident from the vacation, so you need his consent. The recall from the vacation must be issued by an appropriate order, which indicates the reason for which the employee is called from the vacation. In this case, a part of the unused vacation must be provided to the employee at his request at any time. You cannot recall from vacation: - employees under the age of 18; - pregnant women; - employees employed in work with harmful and (or) dangerous working conditions (Article 125 of the Labor Code of the Russian Federation).
Step 4
If the order is canceled before the employee's vacation begins, that is, in fact, the employee has not yet gone on vacation, there is no question of recalling from vacation. In this case, you need to create an arbitrary order to cancel the previous vacation order.
