According to Article 196, the employer determines the need for professional training or retraining of personnel for the needs of the enterprise. He conducts professional development of employees either in the organization itself (courses, lectures, seminars, training), or in educational institutions (special programs). The procedure for improving the qualifications of employees is determined by the collective agreement, labor contract or collective agreements. In addition, the Labor Code of the Russian Federation obliges in some cases the employer to carry out advanced training. Such cases are directly provided for by law or other regulatory legal acts. According to the Labor Code, employees who are undergoing advanced training are obliged to create the necessary conditions for combining study with work, as well as provide social guarantees established by legislation, regulatory legal acts, collective or labor contracts.
