Step 2

The bankruptcy creditor must perform a set of actions so that his property or monetary claims against bankruptcy are satisfied after the final assessment of assets and other property belonging to the debtor. You must prepare an application for inclusion in the register of creditors and submit it with attachments confirming your claims to the arbitration court.

Step 3

In the application, indicate the size of the claims, their composition, including penalties and fines, the date of the claims. Please note: the term for their occurrence must expire before the court made a decision on the bankruptcy of your debtor. If the claim arose after this date, your company will not be entered into the register of creditors. State the essence of the requirements clearly and specifically, indicate the details of all necessary documents and be sure to attach their certified copies to the application.

The deadlines for submitting applications for creditors are limited. Within the framework of the observation procedure and simplified bankruptcy, this period is one month. In bankruptcy proceedings, the deadline for submitting applications is increased to two months, but when an external administration is appointed, there is no statute of limitations, and an application can be submitted at any time. If you miss the deadline for filing an application for inclusion in the register of creditors' claims, your claims will be satisfied after the debts to the enterprises entered in the register earlier are paid. The timing of the introduction is restrictive.

Bankruptcy creditors are usually included in the third line of debt recovery. Priority is given to requirements for current payments, claims of citizens to whom a bankrupt enterprise bears monetary obligations for causing harm to health and those who have claims for wages. As practice shows, creditors fail to fully receive the entire amount of debt.
