A share of an apartment is a part of real estate privately owned by an individual. To rewrite the share to another person, that is, to make it the owner, it is necessary to draw up an agreement on the donation of the share of the apartment and register it with the department of the Federal Service for State Registration, Cadastre and Cartography at the place of residence.
Instructions
Step 1
Collect documents confirming the ownership of the share of the apartment. Without them, the donation contract will not be considered valid. First of all, you will need a certificate of registration of ownership of the share of real estate that is the object of donation. It is also necessary to attach to the package of documents an extract from the house book for the apartment in which the share is located, the original and a certified copy of the cadastral passport and a notarized statement of the donor's spouse that she (he) has no objection to the transfer of the share of the apartment to property to another person.
Step 2
Fill out an agreement on the donation of a share of an apartment, a sample of which can be downloaded on specialized sites on the Internet or obtained from the department of the Federal Service for State Registration, Cadastre and Cartography at the place of residence. To complete the contract, you will need the passport details of the donor and the donee. You will also need to document how much the donated share of the property is estimated and who pays for the transaction costs.
Step 3
Draw up a donation agreement with a notary, and then, as required by Art. 574 of the Civil Code of the Russian Federation, register the act of donation with the Federal Registration Service or its department at your place of residence. If you wish, you can arrange in the presence of a notary a symbolic transfer of the gift in the form of keys to the apartment or room in which the donated share is located.
Step 4
Consult with a notary if you donate a share of real estate to a minor (in this case, the control of the guardianship authorities is required) or a share of an apartment covered by a mortgage loan (bank consent is required). Please note that both parties to the transaction must be legally competent to complete the act of donation. If the share of the apartment is donated to a family member (close relative), it is not subject to property tax.
