A discounted product is a product the value of which has been reduced by the seller in connection with a detected defect or simply in order to increase demand for it. In any case, the buyer has all the rights provided for by the Law "On the Protection of Consumer Rights" if defects are found in the product that were not specified by the seller prior to the moment of sale.
If a product purchased at a discount or at a reduced price is found to have defects that the buyer was not warned about, he may demand from the seller a return, exchange, free repair of such product or termination of the sales contract and a refund (Article 18 of the Law “On Consumer Rights Protection ).
If the buyer claims to return the money or exchange the goods for a similar one, the question of determining its value arises. In such cases, it is necessary to proceed from the amount of money that the consumer actually paid with all discounts.
The law obliges the seller to accept a discounted product with defects from the buyer and, in case of unclear reasons for the occurrence of defects, to check the quality of the product with the participation of the buyer. If the results of the quality control did not satisfy any side of the sales contract, then the seller at his own expense examines the goods. The seller also pays for the delivery of large-sized discounted goods to the place of examination. If the defects have arisen through the fault of the buyer, all the costs of the examination will "fall" on him.
If it turns out that the product was purchased at a discount, and the buyer's demand to replace it due to deficiencies was announced after the end of the sale, when the product is again sold at full price, the buyer should not make any additional payments (Article 24 of the Law "On Protection of Consumer Rights "). You will have to pay extra only if the defective product is exchanged for a product of another brand, more expensive.
In a situation where the buyer does not want to exchange the goods, but requires a decrease in its value due to discovered defects, the price of the goods at the time of the consumer's presentation of such a demand is taken into account.
When purchasing a discounted product, it should be borne in mind that the seller's refusal of warranty obligations for it, the establishment of such conditions as the simultaneous purchase of another item with the discounted item, delivery only at the expense of the buyer, the possibility of handling claims only to the manufacturer, the obligation of additional service and etc. - are illegal. A product sold at a reduced price is subject to the same legal provisions as a product sold at full price. Moreover, any product purchased at a discount or on sales can be replaced or returned on a general basis.
Also, the buyer of a discounted product has 14 days to exchange a non-food product of proper quality that does not fit in shape, size, style, color, size or configuration.
Thus, the buyer of the discounted product retains all the rights provided for by the Consumer Protection Law.
