In accordance with the legislation, the consumer has the right to write a claim if he purchased a defective product. After considering the claim, the manufacturer (seller) is obliged to exchange the goods you purchased for a similar one or return the purchase price in full.

Instructions

Step 1

Inform the seller of the store where you purchased the defective (substandard) product that you have decided to return the purchase. Now start writing your claim. The document does not have a uniform form.

Step 2

In the upper right corner of the claim, indicate the full name of the organization (as a rule, the name is written on the sales receipt). Enter the personal data of the head of the company. Write the details of the company (address, TIN, KPP).

Step 3

Enter your last name, first name and patronymic in full. Write your residence address and contact phone number.

Step 4

In the middle, write the title of the document in capital letters. In the substantive part of the claim, indicate the date of purchase in accordance with the sales receipt. Please fill in the full name of the product, including color, brand, size, and the like. Indicate the purchase price. If the product was purchased at a discount, indicate this fact and the percentage of the discount.

Step 5

Write down the expiration date set by the manufacturer. Indicate the date the marriage was discovered. Write down what happened to the product as a result, what claims you have.

Step 6

Then, referring to Article 18 of the Law "On Protection of Consumer Rights", write that you would like to receive instead of this product a similar one at the same price. If the latter is not possible, then ask for a refund of the purchase price. The seller is obliged to satisfy the claims made by you within seven days from the date of writing the claim.

Step 7

For some non-food products, an examination is assigned to identify defects, which is carried out within 20 days from the date of submission of the claim. The seller is obliged to notify you in writing of the date of its holding in accordance with article 21 of the Law "On the protection of consumer rights".

Step 8

For violation of the law, you have the right to demand payment of a forfeit, the amount of which is 1% of the value of the goods. Referring to the legislation, write that you intend to protect your rights, and if the seller does not comply with the requirements, you go to court.

Step 9

Sign and date the claim. Attach to the document a copy of the cash (sales) receipt, a copy of the warranty card. Leave the originals of the documents with you, so that in the future you can prove your case in court.
