Step 1
According to the fact that the term of the leading position specified in the constituent documents has expired, no additional agreement to the employment contract is provided. If the CEO is selected for the first time, new employment needs to be carried out. The same applies to the case of the election of a CEO from a lower management team. Thus, there are three different situations, depending on which the re-registration or registration takes place.
Step 2
Upon dismissal, the employment relationship ends, and the employer is obliged to pay compensation for unused vacation days, in accordance with article No. 127 of the Labor Code of the Russian Federation, and full payment, in accordance with article No. 140 of the Labor Code of the Russian Federation. The dismissal procedure must be carried out in the regulations of Article 84.1 of the Labor Code of the Russian Federation.
Step 3
If the general director has already held this position, upon dismissal, an entry should be made in the work book that the dismissal took place due to the end of the election period.
Step 4
If an employee from a junior management team is hired for the position of general director, the record is made about the dismissal with a transfer to another position.
Step 5
Hiring is formalized in the general procedure for starting a new labor relationship. You need to be guided by Article No. 68 of the Labor Code of the Russian Federation. If the CEO is re-elected by the board of directors, union members, or shareholders, a document of the decision of the directors, union or shareholders must be attached to the employment contract. In the order for employment, you also need to make a link to this document.
Step 6
Regardless of the fact that the position is elective, you need to sign a document on official duties. All information should be entered into the work book and the director's personal card.
