In the labor process, various changes can occur, for which the management needs to be prepared. One of these changes is the temporary non-participation of an employee in the labor process (for example, maternity leave, advanced training, etc.). The temporarily retired employee must be replaced. But the question is - how to formalize the acting for the position.
Instructions
Step 1
According to article 72.2 of the Labor Code of the Russian Federation, if it is assumed that the vacant position will be temporarily filled by one of the employees of the organization, this employee can be temporarily transferred to this position and for this time be released from his main job.
Step 2
In this case, you will need the written consent of the employee for the translation, without fail. In addition, you will need to issue a corresponding order, as well as make the appropriate changes to the employment contract. The duration of such a period is up to one year.
Step 3
In addition, it is possible to combine this position with an employee without relieving him of his main duties. Of course, a surcharge is due for the combination (article 60.2 of the Labor Code of the Russian Federation). In this case, it is also necessary to issue an order and amend the employment contract accordingly. However, it should be borne in mind that the combination of positions is possible only within the established working hours.
Step 4
The order reflects the full name and position of the absent employee and the additional payment. In this case, the amount of the additional payment is agreed by the employee, who will assume other people's responsibilities, and the employer. At the same time, in relation to employees who hold rank-and-file positions, the following wording is used: “To assign to (name of the position, full name) the performance of duties (name of the combined position) for the period of absence (reason for absence, full name of the absent employee) . Such wording may be contained in a business trip or vacation order. In this case, both employees must familiarize themselves with such an order in a timely manner. A copy of it is placed in the file of the retiring employee, and the extract is placed in the personal file of the person who will replace him.
Step 5
If an employee retires from a managerial position, a different wording is used: "To appoint (name of the position, full name) temporarily acting (name of the position)."
Step 6
If the management requires to temporarily register for a vacant position an employee who does not work in this organization, in this case, it is necessary to take into account the explanation of the State Committee for Labor of the USSR No. 30, as well as the Secretariat of the All-Union Central Council of Trade Unions of Russia No. 39 dated December 29, 1965, according to which the appointment of an employee to the position of acting in the vacant position not allowed. This is possible only by the position to which the higher management body appoints.
