Drawing up a liability agreement protects the employer from losses in the event of negligence of employees, damage to property due to the fault of employees or lack of valuables. In the absence of such an agreement, according to the Labor Code, no more than one month's earnings can be collected from the guilty employee.

Step 1
A liability agreement can be concluded between the employer and the employee with a signed contract (employment contract). The form of the contract on material liability was approved by the decree of the Ministry of Labor N 85 of December 31, 2002. together with the List of positions and jobs providing for the need for such a document.

The liability agreement includes the following points: the subject of the agreement, the obligations of the parties, the procedure for determining the amount of damage and its compensation, the details of the parties.
Step 3
A liability agreement can be concluded with an employee who has reached the age of eighteen. A prerequisite for concluding a contract is a certain nature of a person's work - his job duties are related to the storage, processing and transportation of material values. The employee should be familiarized with the rules for handling valuables for which he is responsible.
Step 4
A liability agreement can be concluded simultaneously with the signing of an employment agreement or later, if necessary. Before signing the contract, an inventory of values is carried out with the preparation of an act. This is necessary to accurately determine the amount of values for which the employee is responsible.
Step 5
The liability agreement is drawn up and signed in two copies: for the employee and the employer. The date of signing the contract is the moment from which the employee is responsible for the values entrusted to him.
Step 6
In addition to the individual liability agreement, collective liability options apply. In such an agreement, among other things, it is necessary to prescribe the procedure for determining the measure of responsibility of each employee.
