Despite the fact that the registration of a donation agreement at first glance seems to be a fairly simple transaction, it requires a thorough and responsible approach. Many do not realize that if they ignore or ignore certain legal points, this transaction can bring negative consequences in the future.

Step 1
For the correct registration of the donation agreement, it is necessary to register with the state registration authorities of rights to real estate and transactions with it (in the Registration Chamber) a pre-assembled package of documents, certified and signed by a notary. The list of documents is as follows:
• Contract of donation of living quarters;
• A certificate from the BTI indicating the inventory assessment of the living quarters transferred by deed;
• The consent of the trustee if one of the parties is incapacitated or under the age of majority;
• Agreement on the fiduciary execution of a deed of property (if a person authorized by your power of attorney is engaged in the execution of the donation agreement);
• Certificate of state registration of ownership of the donated property;
• Documents proving the identity of the parties;
• Cadastral passport of the property for which the deed of gift is drawn up;
• Consent of the donor's spouse (certified by a notary), if the property transferred under the donation is joint property of the spouses;
• A document confirming the donor's ownership of the alienated property, certified by an official responsible for registering citizens at the place of residence.
• Certificate on the composition of registered persons in the alienated residential premises at the time of the conclusion of the donation agreement.
Step 2
Remember to register the transfer of ownership from the donor to the person being gifted. Remember that state registration of the donation agreement is required. Specify in advance the complete list of documents required to register a donation agreement in the registration chamber in which you plan to conduct a transaction. This will save you time. the list of documents to be submitted may vary slightly in different places.
Step 3
Do not forget to receive a receipt confirming that the registration chamber employees have received documents from you for state registration of the donation agreement. The receipt must indicate the date of submission of the package of documents, a list of documents indicating their names, the number of sheets and copies.
Step 4
After the state registration of the donation agreement, you will receive a certificate of state registration of property rights and a donation agreement. Also, you must return other documents submitted for registration according to the receipt you have.
