On the basis of Article 74 of the Criminal Code of the Russian Federation, if persons conditionally sentenced to correctional labor or imprisonment evade compensation for harm caused by the crime committed, then the court, on the proposal of the body exercising control over the behavior of the conditionally convicted person, has the right to extend the probationary period. But no more than one year.

At the same time, if the conditionally convicted person during the probationary period extended by the court again evades compensation for the specified harm, then the court can cancel the conditional punishment, and the imposed punishment can be actually executed.

Compensation for harm to the victim will now also be a prerequisite for the application of parole or early removal of a criminal record. Moreover, on the basis of the amendments and additions made to the Criminal Procedure Code of the Russian Federation, the victim was granted the right to participate in the consideration of issues related to conditional early release from punishment, as well as to replace the unserved part of the sentence with a milder type of punishment.

Also, the legislator has significantly expanded the list of the rights of the victim in criminal proceedings. In particular, the victim is given the right to get acquainted and receive copies of procedural documents affecting his interests. For example, about the appointment of examinations; on termination or suspension of criminal proceedings; on the direction of the case according to the jurisdiction; on the refusal to elect the accused as a preventive measure in the form of detention; on the arrival of the convicted person to the place of serving the sentence.

However, the victim must declare his desire to receive information about this in court before the end of the debate of the parties.
