If you receive a salary "in an envelope", be prepared for the fact that, over time, you will have to prove the fact of its payment in the tax authorities or in court, for example, when calculating a pension.
Instructions
Step 1
Collect all the necessary evidence that the employer pays you "black" salary. Information can be obtained from open sources or relate to the so-called "creative evidence" (for example, audio and video recordings of your conversations).
Step 2
Collect evidence from open sources of information, namely:
- a vacancy announcement in the media for which you found a job;
- Goskomstat information on the approximate level of income from work in your specialty in a particular region;
- information about the average salary received from professional associations (if your specialty requires them);
- pay sheets and copies of statements;
- envelopes with your surname (as well as the surnames of your colleagues), into which the employer laid out the salary;
- other documents proving that the employer conducted double-entry bookkeeping (completed work orders, notes of the head, which he personally wrote for the chief accountant, etc.);
- a certificate of the real salary, certified by the accounting department. In order to get it, refer, for example, to the fact that you are going to get a loan. But if you have already had a conflict with the management or your salary is constantly delayed, it will be problematic to get such a certificate.
Step 3
Collect audio and video materials so that later they can be attached to the case and used when questioning witnesses. For example, conduct a survey among employees, get union bail, etc.).
Step 4
Apply to the tax authorities and the court, attaching all the collected evidence to the statement of claim. If you are demanding to recover the amount of wage arrears, ask the court to oblige your management to draw up an employment contract, which must indicate the real amount of salary. Do not file your claims for compensation for moral damage, as in this situation it is not advisable.
