Step 1
The legislation of the Russian Federation does not have a specific rule for drawing up an objection to a cassation appeal. Submit it in writing. In addition, make copies of the document, because it is sent both to the court and to all participants in the case.
Step 2
Write an objection following the example of a response to an appeal, which is available in the arbitration law. In the document, be sure to indicate the name of the court where it will be sent, last name, first name, patronymic, address, passport data, contact phone number of the person from whom the objection is being received. Also list all other parties to the lawsuit.
Step 3
Give an indication of the complaint itself, write when it was filed and for what reason. State your reasons in response to the facts stated in the complaint. If possible, attach any evidence of your reasons.
Step 4
In conclusion, sign the objection to the cassation appeal in person or have your legal representative do it. Please note that when a document is signed by a representative, a power of attorney certified by a notary or another document that confirms these powers must be attached to the paper.
Step 5
Submit the objection and the required number of copies to the court registry. In the arbitration court, this document can be sent by mail to all interested parties by registered letters with notifications. Which in the future can be considered as confirmation that the letters were sent to the addressees.
