Step 1

In a court session, when making a decision or sentence, the judge, according to the law, is obliged to notify the parties about the possibility of appealing against the decision. 10 days are given to appeal. An appeal against court decisions that have not entered into legal force is called an appeal.

Step 2

Appeals are lodged with the same court that issued the contested decision, but with a higher authority. Thus, decisions of justices of the peace are appealed against in a federal district or city court. The decisions of the city court of general jurisdiction can be reviewed on appeal in the regional court. You need to complain about the decision of the regional court or the court of the subject to the Supreme Court of the Russian Federation.

Step 3

The court decision can be appealed even if it has already entered into legal force. Such an appeal against a court decision that has entered into legal force is called cassation. A cassation appeal can be written against any decision of a court of any court, except for the Supreme, within 6 months from the date of entry into force of the decision.

Step 4

Cassations are filed in the same place as appeals. The only exception is arbitration proceedings, where, unlike courts of general jurisdiction, there are special Appellate Courts located in federal centers (usually 2 courts per one subject of the country). Complaints about the decision of the Arbitration Court can be filed with the Court of Appeal, and against the decision made for appeal - in cassation, i.e. Collegium of the Arbitration Court of a constituent entity of the Federation.

If in search of the truth you bypassed all the courts of the country, reached the Supreme Court of Russia or the Supreme Arbitration Court, but did not achieve the desired result, you have the right to complain about the decisions of the courts to the European Court of Human Rights, which is headquartered in Strasbourg. Only postal items are accepted, which must be processed as follows: Cour européenne des droits de l'homme, Conseil de l'Europe, STRASBOURG - CEDEX, FRANCE, F-67075.
