Since January 1, 2007, the concept of “continuous work experience” has ceased to be used as a violation of fundamental human rights and freedoms enshrined in the Constitution, connected with freedom to work and the right of everyone to dispose of their abilities to work. Now, when calculating social benefits and payments, such a concept as the total length of service is used.
Instructions
Step 1
With the introduction of the concept of general experience, you should no longer worry about how not to lose experience - this has become impossible to do, provided that you have a permanent job, the period of admission and dismissal from which is recorded in the work book with an accuracy of one day.
Step 2
According to clause 3 of the "Rules for maintaining and storing work books, making work book forms and providing employers with them," all employers - legal entities and individuals registered as individual entrepreneurs, keep work books for each employee. These employers do not include individuals who are not registered as individual entrepreneurs, only they cannot make entries in the work books of employees. It follows from this that each entry in your work book about admission or dismissal to work must be certified by the seal of the enterprise or individual entrepreneur.
Step 3
According to these Rules, the employer is obliged to make an entry in the work book in the event that you have worked for him for more than 5 days. In this regard, it seems illegal for many private entrepreneurs to make the appropriate entries in the work book, motivating this with any pretext: a trial period, the shortness of the work period or the training process.
Step 4
In order not to lose the experience when you worked, all periods when you received official wages must be taken into account in the work book. This means that all tax deductions and payments required by law were made from it, including to the Pension Fund of the Russian Federation.
Step 5
Control the correctness of the entries in the work book. The date of employment, which is indicated in it, must correspond to the date indicated in the employment contract. At the same time, it does not matter whether you worked at the workplace during the specified period or were on vacation without pay, you will go on experience in any case.
Step 6
With the introduction of insurance pension policies, entries in the work book have lost their evidentiary value when calculating a pension. Your insurance retirement record is kept under these policies, the data of which employers are required to submit to the Pension Fund of the Russian Federation.
