Vacation compensation is paid upon dismissal in accordance with Article 127 of the Labor Code of the Russian Federation. Also, compensation for a vacation can be issued at the request of an employee for a period that exceeds 28 calendar days. For the legally prescribed 28 days of annual leave, it is illegal to pay compensation, this is indicated in article No. 126 of the Labor Code of the Russian Federation, although in practice it happens in a completely different way. Also, compensation for unused vacation can be obtained by relatives of a deceased employee in accordance with article 141 of the Labor Code of the Russian Federation.

Instructions

Step 1

Vacation compensation is paid based on the average daily earnings for 12 months. The procedure for calculating and calculating average earnings is regulated by Article 139 of the Labor Code of the Russian Federation.

Step 2

Payment of compensation must be documented in accordance with the requirements of labor legislation.

Step 3

The employee must write an application for compensation for vacation exceeding 28 calendar days. In the application, indicate for how many days of vacation he wants to receive monetary compensation and from what date, month and year he is supposed to replace the annual vacation with cash payments. The application must be submitted for signature to the head of the enterprise. Moreover, it is the manager who decides whether to replace part of the vacation with cash payments or not.

Step 4

Some categories of employees cannot even replace part of their vacation with monetary compensation. These include: persons working in stressful and hazardous conditions; pregnant women; employees under 18 years of age. They must make full use of the annual leave and cannot be recruited or compensated for.

Step 5

If close relatives of the deceased employee want to receive compensation for the vacation, they must apply to the company for the calculation of compensation and payment of the unreceived current salary.

Step 6

Upon dismissal of an employee, compensation for unused vacation days is made on the basis of a letter of dismissal.

Step 7

In all cases of payment of compensation, the employer issues an order of the unified form No. T-8. The order indicates the full name of the employee, the basis for the order and payments on it. The employee is introduced to the order on receipt.

Step 8

Then, a calculation-note of the unified form No. T-61 is drawn up. This document is drawn up by an employee of the personnel department, and the back side is filled in by the accountant of the enterprise.

Step 9

Also, an employee of the personnel department is obliged to enter information in the vacation schedule and in a personal card of form No. T-2.
