Registration of patronage is a special procedure provided for by the current civil legislation of the Russian Federation to ensure the exercise of rights, the fulfillment of duties by citizens who, for health reasons, cannot do this themselves. These citizens are fully capable, therefore, registration of guardianship or trusteeship is not suitable for them. Usually, patronage is issued over the elderly, over the disabled, who are not deprived of legal capacity and are not limited in it. The main document confirming the existence of an appropriate relationship between the assistant and the ward is a contract of assignment or an agreement on trust management of property, other contracts. But before the conclusion of the relevant agreements, the applicant for the role of assistant must submit an application to the authorized bodies.

How to issue patronage over a capable citizen?

The order of registration of patronage and the list of documents required for the implementation of the corresponding procedure are determined at the municipal level. That is why the documents should be applied to the municipality. Thus, the Moscow municipality determined that in order to formalize patronage, personal statements are required from a person who needs an assistant, as well as from an applicant for the role of assistant. Also, these persons must submit their passports on their own. For the purpose of additional verification, an applicant for the role of assistant may be required to obtain certificates from the place of work confirming the nature of employment (availability of business trips). In addition, medical certificates may be requested from the future assistant, confirming the absence of serious illnesses.

How is the application verification procedure implemented?

After drawing up the relevant applications and submitting additional documents to the municipality, the corresponding appeals are registered in a special journal. Verification of applications is carried out on the basis of an analysis of the submitted documents, as well as the results of a request for information from other state and municipal bodies, organizations. In addition, in the process of considering an application, authorized officials are allowed to travel to the place of residence of a person in need of patronage to check his social and living conditions. A similar check can be carried out for the future assistant. Based on the results of all these actions, a decision is made to establish patronage or to refuse to establish it.
