Often there are situations when a mother or father cannot take care of a newborn child due to the fact that it is impossible to leave work even for a while. In this case, paid maternity leave to care for a child up to one and a half years old and unpaid maternity leave up to three years can be issued by a grandmother or another close relative (Article 256 of the Labor Code of the Russian Federation, Article 15 Federal Law No. 81-F3).

Instructions

Step 1

To apply for parental leave for a grandmother, contact your employer with an application. Indicate the start and end date of the leave, bring a certificate from the place of work of the child's parents that they do not use this type of leave, the child's birth certificate. If the mother of the child is sick and for this reason cannot use the parental leave, then present a medical certificate.

Step 2

If you plan to use unpaid parental leave for a child under three years old, then a separate application will be required. If the child's mom or dad has already started taking leave, but are forced to interrupt it, then you can contact the employer at any time and write a statement about the need to take care of a small child.

Step 3

In accordance with the law, the employer has no right to refuse you, no matter what form of ownership your company is.

Step 4

Parental leave is paid at 40% of the 24-month average earnings. If a grandmother works for several employers, an application for a vacation must be written at all enterprises. The allowance can be received at the main place of work, but it is calculated based on all income for 24 months, therefore, to calculate it, get a certificate of income of the 2-NDFL form from all places of work and present it to the accounting department at the main place of work.

Step 5

The minimum benefit amount is 2194.33 rubles per child and 4388.67 rubles for caring for a second or two children. The maximum benefit amount is 13833.33 rubles.

Step 6

Benefit for the care of a child under three years old is not paid, but a bill to extend paid leave is under consideration.

Step 7

If the employer refuses to grant you parental leave, you can contact the labor inspectorate or to work, since the refusal is a direct violation of Russian law and this is done by the authorized bodies.
