Most modern legal problems are resolved in court. If you participate in the court session, you will definitely receive a summons. It will be an official document explaining the reason for your absence from the workplace. However, sometimes it is necessary to reschedule a court hearing to another day.
Instructions
Step 1
If you are unable to appear for a good reason, file a written petition with the court in which the case will be heard. Be sure to indicate in your application:
- full name of the court;
- their surname, first name, patronymic, procedural position in the case under consideration, address of residence;
- the reasons why you are requesting the postponement of the hearing;
- a list of documents confirming this fact;
- the period for which you are asking to postpone the consideration of the case.
The application must be printed in two copies. You will leave one copy at the secretariat of the court, on the second - a note will be made that the application has been accepted. The second copy will remain with you.
The petition can also be sent by telegram to the address of the court.
Step 2
The court session can be automatically postponed if important participants in the process fail to appear without a valid reason. At the same time, if this is repeated several times, it is possible to bring this side of the trial to the court. In this case, the court session is appointed by the judge for a new day. Bailiffs are ordered to be brought to court forcibly. Naturally, this will also entail the postponement of the meeting.
Step 3
The meeting can be postponed also in case of delay until the end of the working hours of the court. In this case, the judge can also make an independent decision to postpone the deadline.
Step 4
In addition, the meeting will be automatically postponed if a public holiday falls on the appointed date, or if one of the participants in the process was not provided with a “duty” lawyer free of charge. In the latter case, the time of consideration can be postponed to a later date in order to enable the appointed lawyer to familiarize himself with the case materials together with the participant whose interests he represents.
Step 5
The date of the meeting will be postponed if there is a motion to schedule a hearing on another day in case of waiting for a response to a lawyer or court request. This petition can be made both orally and in writing.
